This website is owned and operated by Lifetime Keepsakes. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors a selection of cremation urns for purchase. Lifetime Keepsakes is not legally allowed to inter cremains on a purchaser’s behalf. By purchasing an urn you agree to inter the cremains yourself or provide cremains to a registered funeral director. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
When buying an item, you agree that: (i) you are responsible for reading the full item description, including measurements and suitability of use (including columbariums/niches), before making a commitment to purchase: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
Pricing
Prices for our products are listed on the website. We reserve the right to change our product selection and respective pricing for products displayed at any time, and to correct pricing errors that may inadvertently occur. Cancelling / Changing your Order
You may cancel or alter your order prior to us shipping it, free of charge. We strive to ship within 24-48 hours of receipt of your order.
Should you change your mind once your order has been shipped, simply return it within its original packaging within 14 days of the date you received the product (at your own expense), and we will exchange it or offer a refund based upon the original payment method. A return address will be provided for you to ship to, and a refund will be issued once the product is received, inspected and found to be in the same, unused condition as at time of purchase.
Please note Clearance/Sale items are final sale and are not eligible for return or exchange.
Defective Products
We take great care in personally inspecting each urn for any defects or quality issues, prior to offering it for sale. If, however, a defect is found in your product, kindly contact us directly.
Return and Refund Policy
Please unpack your urn immediately upon receipt to ensure that no damage has occurred during transit. Any damage claims due to shipping must be made within 48 hours.
If your urn is received in a damaged state, please take photos of the damage, and contact us directly at info@lifetime.ca or call (416) 704-0095, to discuss refund or replacement. If we are unable to replace the product within a suitable timeframe, you will be entitled to a full refund. You are not required to return damaged products.
Limitation of Liability
Lifetime Keepsakes is not responsible for loss or damage to urns or their contents due to accidents, breakage or loss, once the urn has been received by the purchaser.
The Site, including the content and services it offers, is made available to you without any guarantee, whether express or implied. Lifetime Keepsakes does not guarantee that the functions offered on its site will be uninterrupted, will not contain errors, viruses or other nuisances. Lifetime Keepsakes cannot, in any case or circumstance, be held liable for any direct or indirect damages resulting from the use of the Site, its content or the services offered or the impossibility to use them, even if Lifetime Keepsakes has been notified of the possibility of such damage.
Applicable Laws
These conditions of sale are governed by the laws of the province of Ontario and the laws of Canada that apply to them and must be interpreted in accordance with these laws. Any dispute must be submitted to a competent court in the province of Ontario. If a stipulation of the present conditions of sale is illegal, null or not applicable, then this stipulation will be deemed unwritten without restricting the scope of the other provisions.
The terms of sale and any other legal notice or any other statement appearing on the Site constitute the entire agreement concluded between you and Lifetime Keepsakes with respect to the use of the Site, including its content. You agree to indemnify and hold Lifetime Keepsakes harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or purchase of any urns offered on the website.
Force Majeure
Lifetime Keepsakes will not be liable for the non-performance, in whole or in part, of any of its products or obligations to you, or any damages or losses that you may suffer, if the non-performance, damages or losses result from a case force majeure or circumstance beyond its control.
